The terms for using oomny apps and this website. Your data is yours. Purchases use the relevant store or, where offered for Tondo, our website checkout. Your consumer rights always apply.

1 The short version
Our apps are distributed through Apple’s App Store and Google Play. The relevant store handles its payments and refunds under its terms. Tondo also supports website purchases where offered, as described in section 4. Some apps offer a one-time purchase; subscriptions apply only where stated on the purchase screen. Your content remains yours, with storage and sharing described in our privacy policy. Your mandatory consumer rights always apply.

3 Your licence to the app
When you get an oomny app, we grant you a personal, non-transferable, non-exclusive licence to use it on compatible devices you own or control, in line with the applicable platform store’s usage rules. The app, its name, design and code remain ours; please do not copy, resell, reverse-engineer or redistribute it, except where the law expressly allows.
4 Purchases through Apple and Google
Our iOS apps are distributed and sold through Apple’s App Store under Apple’s standard licensed-application terms, which apply to your use of the app alongside these terms. Apple is the merchant of record: Apple handles the purchase, payment, taxes and refunds. To request a refund, ask Apple at reportaproblem.apple.com. If something doesn’t work and Apple says no, write to us anyway — we’d rather fix the problem.
Our Android apps and their in-app purchases are distributed through Google Play. Google Play handles payment through its billing system. Refund eligibility depends on the purchase and applicable rules; see Google Play’s refund policy. You can also contact us about purchase problems or a refund request. Your mandatory consumer rights remain unchanged.
One-time purchase (most apps). A one-time purchase unlocks the features or ad removal stated on the purchase screen without a recurring charge. Family Sharing applies only to eligible Apple purchases where enabled; it does not transfer a purchase between Apple and Google Play. For Tondo website purchases, Oomny B.V. supplies the licence and Lava processes payment. The checkout shows the total price and currency before payment. This is a one-time payment, not a subscription. The licence belongs to the purchasing Tondo account: use the same sign-in method in the app or explicitly link another supported method. Apple Family Sharing does not apply to website purchases. The app verifies a website licence online and can retain its signed confirmation for up to seven days of offline use; reconnect to refresh it. Deleting your Tondo account ends account access; contact support about an existing website purchase before creating a replacement account. For purchase problems or a refund request, contact [email protected]. Your mandatory consumer rights remain unchanged.
5 Subscriptions (some apps)
This section applies only where an app is offered as a subscription. The app’s App Store page and its in-app purchase screen tell you whether it is, and show the current price before you buy.
- Auto-renewing. A subscription renews automatically for the same period (for example monthly or yearly) at the price shown, unless you turn off auto-renew at least 24 hours before the current period ends.
- Billing. Payment is charged to your Apple account at confirmation of purchase, and again at each renewal.
- Managing & cancelling. You manage, switch or cancel the subscription in your Apple account settings (Settings → your name → Subscriptions). Cancelling stops the next renewal; you keep the paid features until the end of the period you have already paid for.
- Free use without a subscription. Where an app offers a free tier, it stays free for as long as you like; the app’s own description states what is free, what a subscription unlocks, and whether a trial applies.
6 Your data is yours
What you create in an oomny app is kept on your device and, where offered, in your own iCloud. In-game messages and chosen photos are relayed through our infrastructure as described below. A Tondo account is optional for ordinary app use and store purchases, and required for a website licence. Signing in for licence access does not upload projects. The app’s data flows are described in our privacy policy and its platform store privacy disclosures.
Where an app lets you collaborate with another person, or record information about someone else, you are responsible for having any permission you need, and for the accuracy of what you produce in the app.
Some games have a chat beside a match against another person. Messages you send there are relayed and briefly stored on our infrastructure so your opponent can receive them; how, and for how long, is set out in the privacy policy. You are responsible for what you write. Do not use the chat for anything unlawful, abusive, hateful or harassing, and send nothing you have no right to share. Your opponent can report any message and block you, and we may remove messages or close a conversation where a report, these terms or the law warrants it. Reported messages are reviewed within 24 hours.
7 Generated content (some apps)
Some apps generate text or structure using on-device intelligence. That output is produced on your device, and may be imperfect or incomplete — please check anything that matters before relying on it. It is a helpful starting point, not professional, legal, financial or medical advice.
8 Using this website
You may use this site for your own information. Please don’t misuse it — no attempts to break, overload, scrape at scale, or gain unauthorised access to it or to anyone’s data. The content, design, names and logos on this site are ours or our licensors’ and are protected by intellectual-property law; you may not reuse them without permission.
9 Conformity and what we can’t promise
We provide our apps and this website with reasonable skill and care, and keep each app in conformity with what we describe — including the updates, security updates among them, needed for it to keep working as described for a reasonable time. This is in addition to your statutory rights for digital content under EU and Dutch law.
That said, no software is perfect. The apps and this website are provided on an “as is” and “as available” basis to the extent the law allows, not with guarantees of uninterrupted perfection. Nothing here excludes or limits any warranty or right that may not lawfully be excluded or limited, including your mandatory rights as a consumer.
10 Limitation of liability
To the extent permitted by law, Oomny B.V. is not liable for indirect or consequential loss arising from your use of our apps or this website, and our total liability is limited to the maximum extent the law allows. This does not limit our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited — including mandatory Dutch and EU consumer-protection rules.
11 Apple
For apps obtained through Apple’s App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple is not responsible for the app or its support; we are.
12 Governing law
These terms are governed by the law of the Netherlands, and disputes fall to the competent Dutch courts. If you are a consumer in the EU/EEA, the mandatory consumer-protection rules of your own country of residence always continue to apply, and nothing here removes that protection.
13 Changes
If we change these terms we will update this page and the date at the top.
